Terms and condtions of hosting, contract between sole trader, Alan Hemmings, trading as netCatalog hosting, referred to as "us" or "netCatalog" in this document, and "you":

1. Indemnity
   You agree to indemnify netCatalog from any claims of any nature arising from the site being hosted, or out of your use of our services or as a result of any content that you load onto the website.
2. Uptime Guarantee
   netCatalog guarantees that the uptime for hosting and email services for Power hosting will be no less than 99% availability, and 99.9% for professional hosting and a 99.99% uptime guarantee for clustered hosting. Should a website be unavailable or "down" due to a technical problem with the hosting from netCatalog, for one minute longer than the allowable time, then netCatalog will refund the amount paid for hosting for that month.
3. Limitation on liability
   You agree that the maximum amount that netCatalog can be held liable for, under any circumstance whatsoever, cannot exceed the lesser of either two thousand rands, or the amount that you paid us for any services provided within the last 12 months.
4. Right of refusal
   netCatalog reserves the right, to discontinue any website and refund, pro-ratio any amounts paid for the month, for any reason that Software On the Move, in it's sole discression may deem necessary, or as a result of any legal or other obligation to do so.
5. Adjustments
   netCatalog reserves the right to adjust any aspect of the terms and conditions of hosting, including, but not limited to the monthly fees, and will provide a 1 month notice of any changes. Continued use of netCatalog services will be deemed as acceptance of the adjusted terms. If you do not agree with any adjustments then you must write to netCatalog and your hosting will continue under the original contract and terms that you agreed to. (please see point above.)
6. Fair use -> "unlimited traffic"
   Unlimited traffic is to allow high traffic websites that receive lots of visitors to serve content and web pages efficiently and is not to be used to run any type of file sharing or video or music download website. In order to avoid the unlimited traffic from being abused, the following items are excluded from the "unlimited traffic" offer:
   
   • Any individual file on the website larger than 350Kb per file.
   • Any single webpage, that when downloaded results in more than 350kb of traffic.
   • All MP3, AVI, MPEG and other streaming media or high bandwidth mutlimedia files larger than 350Kb each.
7. Bandwidth charges for hosting multimedia files:
   You agree that should we deem your usage to be violating our "unlimited traffic policy" to pay 35 cents per megabyte for all traffic that your website generates that falls outside of the "acceptable use" of the unlimited traffic offer.
8. Protection of servers
   Net catalog reserves the right to suspend any domain that netCatalog at it’s own discression may deem to be interfering with the normal running of any of our servers or services.
9. Terms and conditions for registering domains delegated in the CO.ZA Domain Name Space.
   By ordering hosting services from netCatalog you state that you have read Uniforum's terms and conditions and that you agree to be bound by these terms and condtions, which govern the registration and use of all .co.za domains.
